Terms of Use for Top Elcodis

1. Acceptance of Terms

By accessing or using the Top Elcodis website, topelcodis.com (the “Site”), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the Site.

2. Use of the Site

You may use the Site for lawful purposes only. You may not use the Site:

In any way that violates any applicable federal, state, local, or international law or regulation.    
To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.    
To impersonate or attempt to impersonate Top Elcodis, a Top Elcodis employee, another user, or any other person or entity.    
To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by us, may harm Top Elcodis or users of the Site or expose them to liability.    

3. Intellectual Property

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Top Elcodis, its licensors, or other providers of such material and are protected by Serbian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.  

4. Disclaimer

The Site and its content are provided “as is” without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Top Elcodis does not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or other harmful components.  

5. Limitation of Liability  

In no event will Top Elcodis be liable for any damages whatsoever, including but not limited to any direct, indirect, incidental, consequential, special, or punitive damages, arising out of or in connection with your use of the Site or any content on the Site, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not Top Elcodis has been advised of the possibility of such damages.  

6. Indemnification

You agree to defend, indemnify, and hold harmless Top Elcodis, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms of Use or your use of the Site, including, but not limited to, your user contributions, any use of the Site’s content, services, and products other than as expressly authorized in these Terms of Use, or your use of any information obtained from the Site.  

7. Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of Serbia, without regard to its conflict of law provisions. You agree that any legal suit, action, or proceeding arising out of or relating to these Terms of Use or the Site shall be instituted exclusively in the courts of Serbia.  

8. Termination

Top Elcodis may terminate your access to all or any part of the Site at any time, with or without cause, with or without notice, effective immediately.

9. Changes to these Terms of Use

Top Elcodis may revise and update these Terms of Use from time to time in its sole discretion. All changes are effective immediately when we post them.
